NOTICE OF SALE OF PROPERTY WITH MIXED SYNCHRONOUS MODE

The undersigned Avv. Paola Baleani, professional delegated in executive procedure no. 12412002 promoted by Banca Nazionale del Lavoro, having regard to the provision of proxy for the sale issued by the Judge
of the Execution of the Court of Fermo on 09/24/2019 pursuant to art. 591 bis c.p.c .; having regard to art. 569 cpc.

NOTICE

that on 8 april 2021 at 10.00 pm at the ESIM headquarters in Fermo (FM), at Via Ognissanti, 13, the sale without enchantment with mixed synchronous modality of the assets indicated below and analytically described in the expert opinion drawn up by CTU Geom. Giustino Gianni to whom express reference is made.

LOT 02
Full ownership rights on a warehouse of approximately 67 square meters gross in the basement, which is part of a building located in the Municipality of Grottazzolina, Via Bolzetta n ° 12.
List of Buildings Cadastre of said municipality on sheet 7, parcel 437: 1, categ. Cl2, class 7, 62 square meters, total cadastral area 75 square meters, RC € 80.05.


The warehouse has a gross surface area of ​​approximately 67 square meters divided into various rooms. as well as a cave measuring approximately 5.40x1.08 meters. The useful heights vary from a minimum of 2.25-2.50 meters to a maximum of 3.00 meters. The fi nishes and the technological systems are all in a bad state of maintenance and conservation. Inside a walled room, there would also be a well.

Cadastral and building compliance: for the plans there are differences in the internal layout of the various spaces as well as an extension of the terrace on the top floor. The Land Cadastre map also needs to be updated using the Map Type, as the West part (where the aforementioned terrace stands with its underlying rooms) is not shown.

It requires building amnesty, with the related charges and costs to be borne by the successful bidder. As for the certification of conformity of the plants, it was not possible to find it. the successful bidder pursuant to
D.M. 22.01 .2008 n. 37 will declare to irrevocably renounce the guarantee of conformity of the systems and to take full responsibility for the costs and expenses of adapting the systems to the safety legislation by raising pursuant to art. 1490 of the civil code, the bodies of the executive procedure hold any responsibility in this regard.

Status of Possession: the property is free.

METHOD OF SALE

- Lot 02 is offered for sale at the basic price of Euro 5,500.00 plus legal taxes.

Purchase offers, which are irrevocable except for the cases referred to in art. 571 co. 3 cpc .. must be sent by the bidders through the telematic modality or through the traditional modality as better described below.
The submission of the offer implies knowledge of this notice, the appraisal and other documents and constitutes acceptance of the conditions of sale.

TELEMATIC MODE

The purchase offer for the purposes of participation in the tender must be received by the bidder by 12.00 on the day prior to that set by the sales representative; it must be drawn up using the ministerial web form “Telematic Offer” accessible through the appropriate "SEND OFFER" function present in the portal www.spazioaste.it.

TRADITIONAL MODE

The purchase offers may alternatively be presented in a sealed envelope at the law firm Paola Baleani, Largo Manara, 10, Fermo (tel. 3394726840) by 12.00 on the day before the auction (Saturday excluded).


The properties can be viewed upon agreement with the custodian of the Marche Judicial Sales Institute, Via Cassolo n. 35, Monsano (AN), tel. 0731-60914.
