Deposit

The present auction is subject to a deposit of  EUR 40.000,00.

Lots Availability
 
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.

Property transfer

The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator

Payment deadline
 
Awarded lots have to be paid in full within 60 days from the provisional awarding.

Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.

Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full  within  60 days from the provisional awarding.


Buyer's Premium
 
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law). 
 
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
 
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.


VAT: 
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)


In case of insurgency of  any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website  translated in different languages, it will be applied the Italian language version of such texts

Se destaca que los bienes se ponen a la venta en su totalidad, considerando que se ha firmado un contrato preliminar de compraventa con fecha 04/05/2022, debidamente inscrito, que tiene como objeto la transferencia a favor de la sociedad fallida - ya propietaria de la mitad - o a terceros a designar de la otra mitad de los terrenos, que se transferirá después de la adjudicación.

Los terrenos edificables de 12.425 metros cuadrados se encuentran en el sector edificable denominado C3.2 Lu Gialdinu y pertenecen a la subzona C1.10 (art. 35 NTA Plan Urbanístico Municipal de Santa Teresa Gallura) y, en cualquier caso, son terrenos sujetos a parcelación con los límites y restricciones urbanísticas derivadas de la aplicación de la norma de referencia a la subzona C1.10.

El Curador se reserva la facultad de recibir y evaluar ofertas por debajo del precio base indicado en el límite del 25%.
Estas ofertas solo se evaluarán después de la finalización de esta subasta a discreción de los Órganos del Procedimiento, únicamente en ausencia de ofertas irrevocables por un monto igual o superior al precio base.
Para formular una oferta en las condiciones recién descritas, los posibles interesados NO deben seguir el proceso de "PERFECCIONAMIENTO DE LAS OFERTAS AL PRECIO BASE DE LA SUBASTA", sino que deben enviar una solicitud a la dirección de correo electrónico certificado gorealbid@pec.it para conocer los procedimientos de presentación y recibir el formulario de oferta correspondiente.
En cualquier caso, las ofertas irrevocables de compra presentadas en base a las condiciones mencionadas anteriormente estarán sujetas a la aplicación del Recargo del Comprador más el IVA legal, como se indica en las condiciones generales y específicas y en el aviso de venta adjunto.
