Each participant in the sales tender is responsible for taking a prior, complete and accurate view of the sale notice, the appraisal report, the general and specific conditions of sale published online and any further documentation relating to the lot for sale.

Deposit

The present gathering is subject to a mandatory deposit of 10% of price offered.

Participation Rules:

Participation in this sale is regulated by the conditions set out in the attached Sale Notice which the user is required to consult.

Lots Awarding

Once the tender has been completed, unless an irrevocable improved purchase offer is presented pursuant to art. 107, 4th paragraph, L.F. and after 10 days from the obligations referred to in the art. 107, paragraph 5 of the L.F., it will be possible to proceed with the definitive award.
If, however, following the outcome of the online tender and in any case no later than 10 days from the obligations referred to in the art. 107, paragraph 5, L.F., should the Receivership receive an irrevocable improved and secured purchase offer for an amount not less than 10% of the provisional award price, the Procedure Bodies will evaluate the carrying out of a further auction on line which will have as its base price the amount of the increasing offer or the best increasing offer.

Lots Availability

Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on buyer's expenses.

Payment deadline

Awarded lots have to be paid in full within 120 days from the provisional awarding.

Buyer's premium due has to be paid within 20 days from awarding.

Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full  within 120 days from the provisional awarding.

Within the deadline set for the payment of the balance of the awarding price, the successful bidder must provide the trustee with a specific declaration containing the information required by the art. 22 of the anti-money laundering decree (Legislative Decree 21.11.2007, n. 231).


Buyer's Premium

A percentage of 2,60% charge+ VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law). 

The above mentioned percentage charge will be applied according to the modes shown in the following table:


VAT: 
Value Added Tax at a rate 22,00%  will be calculated on the awarding price and added to it. (where applicable). VAT application may vary according to law depending on the awarding subject


In case of insurgency of  any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website  translated in different languages, it will be applied the Italian language version of such texts
