Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Dado que se trata de un lote único que tiene como objeto la transferencia de la plena propiedad, una vez adjudicado el mencionado derecho de superficie gravado en la p.f. 4097/5 se extinguirá por consolidación de la propiedad desnuda y de la propiedad superficial en manos del mismo sujeto.
Según lo previsto en el PRG vigente desde el 02/12/2015, identificado como "Variante General al PRG - Marzo 2015" aprobado por la Junta Provincial con la resolución n. 2056 de fecha 20/11/2015, el área en cuestión se define como "P.A.G. 9", regulada de acuerdo con las "Disposiciones especiales de los Planes de Actuación" del artículo 64 de las normas de aplicación.
Con la resolución n. 2170 de fecha 29/07/2021, el Director de la Provincia Autónoma de Trento autorizó a los técnicos de la administración provincial a acceder a los terrenos en venta para realizar las operaciones necesarias para la redacción del proyecto "Realización de un enlace para Sano en Mori (integración); esta autorización tiene una validez de dos años a partir de la notificación o comunicación de dicho acto.
La sociedad fallida (Fall. n. 19/2015) propietaria de los 35.200 m², ya ha pagado al Municipio tasas de urbanización por un importe de aproximadamente € 925.000,00.
Durante el transcurso de las operaciones de venta, el Mandante se reserva el derecho de aceptar ofertas por debajo del precio base indicado en un límite del 25% (previo reconocimiento del correspondiente Buyer's Premium). Estas ofertas serán evaluadas después de la finalización de la subasta a discreción de los Órganos del Procedimiento.
