Deposit

The present auction is subject to a deposit of  EUR 18.800,00.

Lots Availability

Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on buyer's expenses.


Payment deadline

The payment of the balance of the price must take place within a period not exceeding 60 days from the provisional award.

The Buyer's Premium due must be paid within 10 days of the award.

The expenses relating to the sale to be paid by the buyer (tax and non-tax charges, legal taxes, notary charges) must be paid within 60 days of the provisional award.


Buyer's Premium

A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law). 
 

The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.

For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.


VAT: 
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)


In case of insurgency of  any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website  translated in different languages, it will be applied the Italian language version of such texts

According to the changes made to the PGT, the body shop activity will no longer be able to be carried out in the property.

TECHNICAL RULES FOR THE IMPLEMENTATION OF THE PGT IN FORCE OF BRESCIA
• Art. 85. Areas of landscape-environmental value The PR identifies the "Areas of landscape-environmental value" pursuant to art. 10 letter c.) point 2, of the Regional Law. n.12/2005.
• c. Environmental protection and mitigation areas (classification of the area where the building is located)
As regards the existing buildings, the main intended use is agricultural.
"Services and equipment" (S) (with the exclusion of technological services), "Management activities", "Residences", Accommodation activities, Craft service activities (excluding vehicle repairs), and Production activities of intangible goods are permitted. "Manufacturing, Logistics Activities" and Commercial Activities are excluded

• Art. 86. Special provisions for the Local Park of Supra-municipal Interest (PLIS) of the Hills and its extension to the Mella - In the safeguard areas within the perimeter of the Local Park of Supra-municipal Interest of the Hills of Brescia recognized by resolution of the Provincial Council dated 22 November 2002 n. 547 objectives of safeguarding and enhancing natural environments and enhancing agriculture are pursued. In this sense, the reactivation of agricultural and silvicultural practices is promoted.


It should also be noted that with regard to the discrepancies found on the property and indicated in the appraisal, the Municipality in the Building Commission will decide on the demolition, or on the application of the sanction, estimated by the expert and already deducted from the sale price (page 70 of appraisal).
