Deposit

The present auction is subject to a deposit of  EUR 6.000,00.

Lots Availability

The deed will simultaneously provide for the exercise of the right of redemption by the Bankruptcy Party of the premises owned by Banco BPM on the basis of the real estate leasing contract and the consequent transfer of the property in favor of the final successful bidder.
The Delegated Judge, upon request of the Trustee, will provide by decree for the cancellation of any registrations relating to pre-emption rights, as well as any registrations of seizures and seizures and any other restrictions registered on the areas, pursuant to art. 108 L.F.
All expenses, charges (including VAT) and taxes relating to the cancellation of any prejudicial registrations are borne by the successful bidder.
The successful bidder is required to pay, at the time of signing the sales contract by means of bank transfers made out to the Notary in Charge, an amount corresponding to the expenses relating to the auction procedure and the sale such as, by way of example and not limited to: fees notary fees, taxes, duties, accessories, expenses for stamps and related charges of any kind, without any possibility of compensation against the Procedure.
The Judge will therefore order the cancellation of all mortgage registrations and all registrations encumbering the property, which will be canceled at the care and expense of the purchasing party.

Payment deadline

The payment of the balance of the hammer price (equal to the hammer price less the deposit given plus VAT if due) must be paid in a single payment, by bank transfer to the procedure account, bound to the order of the Delegated Judge, to the coordinates IBAN: IT93O0569603227000005222X08 - specifying in the reason: “Bankruptcy n. 70/2013 ENGINEERING CAPITOLINA COSTRUZIONI S.R.L. - Balance of the property auction price via ---” within 5 days before the date of signing.

The sale deed will simultaneously provide for the exercise of the right of redemption by the Bankruptcy Party of the premises owned by Banco BPM on the basis of the real estate leasing contract and the consequent transfer of the property in favor of the final successful bidder.

In the same term, the successful bidder will have to pay the sums (fiscal and non-tax charges, legal taxes) into expense accounts for the payment of expenses relating to the sale.


Buyer's premium due has to be paid within 20 days from awarding.


Buyer's Premium

A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law). 
 
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.

For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above. 


Lot VAT: 
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)


In case of insurgency of  any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website  translated in different languages, it will be applied the Italian language version of such texts

En fecha 18.09.2023 se presentó la SCIA en sanatoria prot. CF 2023/178298 con el fin de regularizar los abusos detectados en la unidad inmobiliaria identificada en el catastro con el sub 1.
El estado actual de la tienda identificada en el catastro con el sub 1 es conforme a lo representado en el proyecto adjunto a la SCIA en sanatoria prot. CF 2023/178298.
