Deposit
The present auction is subject to a deposit of
EUR 38.000,00.

Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Det bemerkes at eiendommene selges i sin helhet, ettersom det er inngått en foreløpig kjøpskontrakt datert 04/05/2022, som er korrekt registrert, som omhandler overføring til selskapet konkurs - tidligere eier av 1/2 andel - eller til tredjeparter som skal utpekes for den gjenværende andelen av eiendommene, som derfor vil bli overført etter tildelingen.
Byggetomtene på 12.425 kvm faller inn under byggeområdet kalt C3.2 Lu Gialdinu og ligger i underområde C1.10 (art. 35 NTA Kommunal Plan for Santa Teresa Gallura) og er uansett område underlagt regulering med begrensninger og bygningsmessige-urbane restriksjoner som følger av anvendelsen av referanseregelen for underområde C1.10.
Kuratoren forbeholder seg retten til å motta og vurdere tilbud med beløp lavere enn den angitte minsteprisen innenfor 25%.
Disse tilbudene vil bli vurdert først etter at denne auksjonen er avsluttet, etter skjønn fra prosedyreorganene, kun i fravær av uoppsigelige tilbud med beløp lik eller høyere enn minsteprisen.
For å legge inn et tilbud under de nettopp beskrevne betingelsene, må eventuelle interesserte IKKE følge prosedyren for "FULLFØRING AV TILBUD TIL MINSTEPRIS FOR AUKSJON", men må sende en forespørsel til e-postadresse gorealbid@pec.it for å få vite hvordan man skal presentere og motta det relevante tilbudsskjemaet.
Uansett vil uoppsigelige kjøpstilbud som legges inn i henhold til de ovennevnte betingelsene være underlagt anvendelsen av Kjøpers Premium pluss lovpålagt MVA, som angitt i de generelle og spesifikke betingelsene og i salgsannonsen vedlagt.
