The present auction is subject to a deposit of

Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Se destaca que los bienes se venden en su totalidad, dado que se ha firmado un contrato preliminar de compraventa con fecha 04/05/2022, debidamente registrado, que tiene por objeto la transferencia a favor de la sociedad en quiebra - ya propietaria de la cuota de 1/2 - o a terceros a designar de la cuota restante de los terrenos, que será transferida después de la adjudicación.
Los terrenos edificables de 12.425 m² se encuentran en el sector edificatorio denominado C3.2 Lu Gialdinu y pertenecen a la subzona C1.10 (art. 35 NTA Plan Urbanístico Municipal de Santa Teresa Gallura) y, en cualquier caso, área sujeta a parcelación con los límites y restricciones edilicias-urbanísticas que derivan de la aplicación de la norma de referencia a la subzona C1.10.
El Curador se reserva el derecho de recibir y evaluar ofertas de importe inferior al precio base indicado, hasta un límite del 25%.
Dichas ofertas serán evaluadas solo después del término de esta subasta a juicio exclusivo de los Órganos del Procedimiento, únicamente en ausencia de ofertas irrevocables de importe igual o superior al precio base.
Para formular una oferta en las condiciones recién descritas, los interesados NO deberán seguir el procedimiento de "PERFECCIONAMIENTO DE LAS OFERTAS A PRECIO BASE DE SUBASTA", sino que deberán enviar una solicitud a la dirección de correo electrónico gorealbid@pec.it para conocer las modalidades de presentación y recibir el correspondiente formulario de oferta.
En cualquier caso, las ofertas irrevocables de compra presentadas bajo las condiciones mencionadas estarán sujetas a la aplicación del Buyer’s Premium más IVA de ley, como se indica en las condiciones generales y específicas y en el aviso de venta adjunto.
