Deposit
To participate in the auction, a specific deposit must be paid for each lot, the amount of which is detailed in the respective lot sheet.

The deposit must be made via bank transfer to the following account:

Reference: auction number and lot number

All bidders must deposit the amount indicated in the respective lot sheet into GOBID ESPAÑA SL's account, except for the creditor, who is not required to deposit the amount.

Only once the deposit has been received in the specialized entity's account will the user be authorized to participate in the auction.

To expedite auction participation, it is recommended to send proof of payment to info@gobid.es.

The bidder who submitted the offer for Lot 5, communicated to the court on May 6, 2024, is exempt from depositing the guarantee to participate in the auction of that lot. However, to participate, it will be necessary to send an email to the previously provided address, indicating their position and providing the documentation required for other interested parties.

Users who participated in the auction but did not win any lot will receive their deposit within 20 working days from the auction's conclusion.

If, after making the deposit and winning the lot, the bidder fails to complete the acquisition by paying the sale price and the Buyer’s Premium, the deposit will be retained.

In this case, the lot will be awarded to the next highest bidder who has made an offer equal to or above the reserve price.

For the winning bidder, the deposit paid to participate in the auction will count toward the amount due for the lot.

Charges
The sale of assets is conducted free of charges and encumbrances. However, all applicable taxes, duties, and fees related to the award, sale, or transfer of each asset will be the responsibility of the winning bidder or buyer.

Awarding of lots
The lot will be awarded to the user who submits the highest bid for each lot, provided that the bid is equal to or higher than the minimum sale price set for the auction.

At the end of the auction, the specialized entity will communicate the result to the court for approval of the award, provided the bid meets or exceeds the minimum sale price.

Only once the offer has been approved by the court will the award confirmation be sent to the highest bidder with instructions for making payments within the specified time frames.

If the payments are not made within the specified time, the award will be void, and the deposit forfeited. Similarly, if the winning bidder withdraws, their deposit will also be forfeited.

In case the designated highest bidder withdraws, their deposit will be allocated to the execution process, deducting the expenses incurred by the specialized entity. Additionally, the specialized entity may request the court to declare the next highest bidder as the awardee.

Payment terms
All payments must be made exclusively via bank transfer to the account provided in the award confirmation (see general auction terms).

Once the payment is received, the specialized entity will transfer the amount to the Deposits and Consignments account, deducting the Buyer’s Premium (specialized entity's fee).

Payment deadline
The payment for the awarded lot and the Buyer’s Premium must be made within 10 business days of the award notification.

Lot withdrawal conditions
A maximum withdrawal period of 30 days is established from the provisional award confirmation. If the purchased lot is not withdrawn within the established period, the sale will be canceled, and the amounts paid will be retained as compensation for the damages caused.

The buyer must carry out withdrawal operations in compliance with current safety regulations, coordinating appropriately with third parties, collaborators, or employees. The buyer is responsible for any disassembly, movement, loading, and transportation of the awarded lots. For vehicles, they are also responsible for property transfer and other corresponding procedures.

In any case, no lot will be made available to the buyer until all payments have been made and, in the case of registered movable property, until the corresponding property transfer is completed.

Other specific conditions

Auction suspension: If the auction is suspended due to reasons attributable to the proposer, the proposer will bear the resulting costs, as well as those for organizing the auction and selling the assets. These costs will be prudently established based on the auction's progress and approved by the Court Clerk upon justification.

Buyer’s Premium: A fee of 7,50% (plus 21% VAT, if applicable) of the lot's awarded price will be added to it.

VAT: 21% VAT on the sale price will be borne by the buyer and calculated on the awarded price (if applicable).

Extra-Time: If a bid is placed in the last 5 minutes, the deadline will be extended by an additional 5 minutes, and the countdown will restart. This process will continue until no bids are placed in the last 5 minutes of extra time.

The sale of assets will be conducted in their current condition, both physically and legally. It is recommended to visit the lots for sale.

All expenses related to the sale, including withdrawal and transportation costs, property transfer expenses, notarial deeds, and cancellation of encumbrances in public records, will be borne by the winning bidder.

The winning bidders or buyers may not file claims regarding the physical and/or legal condition of the assets and/or rights, whether in terms of their physical configuration or legal status. By making a bid, bidders expressly waive any such claims; the assets subject to this sale are transferred as-is.

In this sense, bidders are deemed to have expressly accepted the physical and legal condition of the asset being auctioned, without the possibility of price revision or withdrawal from the purchase under any circumstances. The bids submitted are irrevocable. Bidders explicitly waive any claim for hidden defects, as regulated by Article 1,474 of the Civil Code, and expressly release the seller from such obligations.

The Mandatary is excluded from any liability regarding the existence of third-party rights over the assets being sold.

The sale is conducted with the obligation for the buyer to assume their own expenses and responsibility for verifying the actual conformity of the asset offered for sale.

GOBID ESPAÑA S.L. is excluded from any liability arising from errors or inaccuracies in the translation of texts and materials published on the website.
