Deposit

To participate in the Auction, it is necessary to pay a security deposit of EUR 2.500,00.

Lot 0 requires a deposit of EUR 179.000,00.

Lots with an estimated value equal to or greater than EUR 25,000.00 require a specific deposit as indicated in the respective lot sheets. The payment of a specific lot deposit will unlock bidding rights for individual lots covered by the general deposit (basic deposit).

For the remaining lots, i.e. those not requiring a specific deposit, it will be sufficient to pay a general deposit (basic deposit) of EUR 2.500,00.

Interested users must pay the deposit before the auction ends.

Only upon receipt of the deposit will the user be authorized to participate in the Auction.

Secured creditors related to the assets being sold in this auction are exempt from submitting the deposit to bid on the lots for which they hold the credit. To participate, they must send an email indicating their position and submit documentation to justify it.

Users who participated in the auction but did not win any items will be refunded the deposit within 20 working days from the payment date of the awarded amount. If no lots are awarded, the deposit will be refunded within 20 working days from the auction closing date.

If, after paying the deposit and being awarded a lot, the bidder fails to complete the purchase by paying the sale price and Buyer’s Premium, the deposit will be retained.

In such case, the award will be assigned to the next highest bidder who placed a bid equal to or higher than the reserve price.

Encumbrances

The sale of goods is carried out free of liens and encumbrances.

However, all taxes, levies, or charges legally applicable to the award, sale, or transfer of each asset will be borne entirely by the buyers or awarded parties.

The cancellation orders for encumbrances will be issued exclusively by the Court once the Insolvency Administrator certifies the effective transfer of the goods. The Administrator will request cancellation of registered encumbrances, including seizures and those resulting from the insolvency proceedings.

Lot awards

At the end of the auction, if the winning bid equals or exceeds the reserve price, confirmation of award will be sent to the highest bidder with instructions for payment within the indicated terms. If the bid does not reach the reserve price, the award is subject to approval by the Insolvency Administrator.

Warning: The Insolvency Administrator reserves the right to submit the winning offer to the Court for approval. In such cases, confirmation of award will be sent only after Court approval.

Payment method

All payments must be made by bank transfer to the accounts provided at registration or included in the award communication (see General Auction Conditions).

Payment deadline

Payment of the awarded lot(s) must be made within 15 days from the award communication.

The Buyer’s Premium must be paid within 10 days from the award communication.

Withdrawal conditions

The withdrawal of movable goods and inventory will take place only after full payment of the awarded price, the fees of the specialized entity, and any applicable costs. The withdrawal phase will be organized under the Insolvency Administrator’s conditions.

In all cases, withdrawal must be completed within the set timeframe, ranging from 20 to 60 days from the provisional award notice, depending on the lots. The cost for withdrawal is indicated in each lot's sheet under “administrative expenses.” Discounts may be agreed for multiple lots based on actual days required.

GOBID ESPAÑA S.L. is not obliged to organize or facilitate the withdrawal or delivery of lots.

If lots include items like shelves or cabinets containing material not part of the lot, the awardee must remove them without damaging stored material. If this is not possible, the awardee must wait for prior removal.

Withdrawals must comply with current safety regulations; adjustments must be made for both direct employees and third-party operators.

The awardee is responsible for disassembly, handling, loading, transport, decontamination (if needed), and any installation repairs, as well as property transfer in case of vehicles.

GOBID ESPAÑA S.L. will not release any lot before payment and—where applicable—property transfer is completed.

Lot 91 formatting: The awardee must format IT equipment before withdrawal. The formatting cost is the awardee’s responsibility, who must also certify compliance with applicable data regulations.

Decontamination of equipment/elements: If any items require decontamination prior to withdrawal, it must be carried out and fully paid by the awardee in accordance with the law.

Note: Lots 3, 5, 10, 14, and 20 contain a radioactive source registered with the Nuclear Safety Council.

For some lots, a worksite declaration, safety plan, and proof of insurance may be required prior to withdrawal authorization.

Other specific conditions

Buyer’s Premium: 10,00% (plus 21% VAT, if applicable) on each awarded lot.
Minimum Buyer’s Premium: €50 (plus 21% VAT, if applicable) per lot or combination awarded.

Right of first refusal: Lots 71, 81, 82, 83, 84, 85, and 86 are subject to the right of first refusal by the warehouse owner. After the auction ends and the offer is accepted by the Administrator, the owner may match the best offer within 10 working days. If no match is made, the lot will be awarded to the highest bidder.

Prior authorization for foreign companies – Lots 0, 3, 5, 10, 14, and 20:

According to Article 22 of the Nuclear Energy Act, foreign individuals/entities may only be authorized to bid or acquire radioactive material lots upon prior authorization from the Ministry of Industry or the Nuclear Safety Council. Interested foreign companies must email Gobid indicating their intention. Once received, Gobid will provide the required documentation to be submitted. Only upon receiving written authorization will bidding rights be granted.

Administrative expenses: These are additional costs entirely borne by the awardee to cover services related to the sale and post-sale phases. They are to be paid with the Buyer’s Premium, and—if applicable—specified in each lot's sheet.

VAT: 21.00% VAT on the awarded price (if applicable).

Assets with privileged credits

Secured creditors are not required to pay the deposit.

They may assign their awarded lots to third parties.

In case of award, the secured creditor is responsible for paying the specialized entity’s fee.

Extra-Time: If a bid is placed in the last 5 minutes, the auction will be extended by another 5 minutes. Automatic proxy bids will also trigger the extension.

Offers for complete lots: For auctions allowing full lot (lot 0) offers, participants may also bid on individual or combined lots, but full lot offers will take precedence. If combined individual offers exceed the total value, the Insolvency Administrator will decide which to award. If no bid is placed on lot 0, individual lots will be awarded.

Warranties / Liability / Claims

Buyers waive all claims regarding the physical and legal condition of the goods. Assets are sold “as-is.”

No price adjustments or cancellations will be accepted for any reason. Bidders waive any warranty for hidden defects as per Article 1474 of the Civil Code.

It is recommended to inspect the goods before bidding.

All sale-related costs, including removal, transport, title transfers, notarial/registry costs, and lien cancellations will be borne by the buyer.

No post-sale warranties are provided. Damages or defects cannot justify legal or extrajudicial claims.
