Real estate compendium consisting of land located in an area mainly for residential use (Zone B.3 - residential for completion), as well as limited portions falling in areas with different uses, with overhanging 6 buildings, 1 warehouse / deposit of cadastral category C7 and 5 garages of cadastral category C6, currently in a state of abandonment and in any case in serious deterioration, with some parts collapsed; the compendium is located in the Municipality of Marghera, in the western area of the municipal area of Venice, near the Mestre ring road and the tollbooth at the gates of the city.
The area where the building complex stands falls within three different classifications of the V.P.R.G. Municipal for the Mainland. In particular, almost all of parcel 103, as well as the entire parcel 1391, fall within Zone B.3, a completed residential area, while the remaining part (a western strip having an average width of about 9.5 m) falls within within an area intended for equipped green areas.
Parcel 1393, on the other hand, is entirely included within the area destined for green street furniture.
The NTA in article 8.5 provide for the following building parameters for areas B.3:
a) land use index (Uf): 0.70 m2/m2;
b) height of the building (H max): 12.50 ml;
c) distance between buildings (Df): 0 or 10 ml;
d) distance from the border (Dc): 0 or 5 ml;
e) distance from roads (Ds): 5 ml.
For buildings existing on the date of adoption of the VPRG, such as those in question, with the exception of those with a codified type of intervention and those included in the areas of application of the urban landscape redesign methods referred to in Table 13.2, it is always permitted the demolition with reconstruction of equal Sp even if higher than that corresponding to the Uf of the area. Furthermore, for these buildings, if with a Sp of less than 400 m2, expansion is permitted up to the achievement of said Sp.
Any type of building is excluded for areas intended for equipped green areas and street furniture.
